Terms of Service

These Terms of Service ("Terms") govern your access to and use of the FITTIE.ai website (fittie.ai) and the FITTIE mobile application (collectively, the "Services"), operated by FITTIE.ai from Australia. By using the Services you agree to these Terms. If you do not agree, please do not use the Services.

1. Eligibility

You must be at least 16 years old to use the Services. By using the Services you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Account & waitlist

To join the waitlist you must provide accurate, current information. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use.

3. Beta status

FITTIE is currently in beta and not yet publicly available. Features, content, pricing, and availability may change at any time without notice. Beta access is provided "as is" and is intended for evaluation purposes.

4. Health & fitness disclaimer

Important: FITTIE provides general fitness, training, and wellbeing information. It is not medical advice and is not a substitute for advice from a qualified medical professional. Consult a doctor before starting any new exercise or nutrition program — especially if you have a pre-existing condition, are pregnant, postnatal, recovering from injury, or taking medication. You use the Services at your own risk.

5. Acceptable use

You agree not to:

Use the Services for unlawful, fraudulent, or harmful purposes.
Impersonate any person or entity, or misrepresent your identity.
Reverse engineer, decompile, or attempt to extract source code from the Services.
Resell, sublicense, or distribute access to the Services without our written permission.
Upload viruses, malicious code, or content that infringes third-party rights.
Use automated tools (bots, scrapers) to access the Services without consent.

6. User content

You retain ownership of content you submit (workout logs, photos, messages, feedback). By submitting content you grant FITTIE a worldwide, royalty-free licence to use, store, reproduce and display that content solely for the purpose of operating and improving the Services. You are responsible for ensuring you have the rights to all content you submit.

7. Intellectual property

The Services, including all software, designs, text, graphics, logos, and trademarks (including the FITTIE name and logo), are owned by FITTIE.ai or its licensors and are protected by Australian and international intellectual property laws. Nothing in these Terms grants you any right to use our trademarks without our prior written consent.

8. Subscriptions & payments

Pricing, billing cycles, and refund terms for paid plans will be presented at the point of purchase. Founders' waitlist members will receive the introductory pricing communicated to them at the time of signup. All amounts are in Australian Dollars (AUD) unless otherwise stated and include applicable GST.

9. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you breach these Terms, misuse the Services, or as required by law. Sections that by their nature should survive termination (e.g. IP, disclaimers, liability) will continue to apply.

10. Disclaimers

To the maximum extent permitted by Australian law, the Services are provided "as is" and "as available" without warranties of any kind, whether express or implied (including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement). Nothing in these Terms excludes or limits any rights you have under the Australian Consumer Law that cannot be lawfully excluded.

11. Limitation of liability

To the extent permitted by law, FITTIE.ai will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or revenue arising out of your use of the Services. Our total aggregate liability arising from or relating to the Services is limited to the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or AUD $100, whichever is greater.

12. Indemnity

You agree to indemnify and hold harmless FITTIE.ai and its directors, officers and contractors against any claim, loss or expense arising out of your breach of these Terms or your misuse of the Services.

13. Changes to the Services or these Terms

We may modify the Services or these Terms from time to time. Material changes will be communicated by email or via a prominent notice on our website. Continued use after the effective date constitutes acceptance.

14. Governing law & jurisdiction

These Terms are governed by the laws of the Commonwealth of Australia and the state of New South Wales. You and FITTIE.ai submit to the exclusive jurisdiction of the courts of New South Wales and the courts of Australia.
